"Agatha, it's
Dick. My friend W.Dragon has a claim against him in High court, he
needs your help, can you come?"
"Okay, when?"
"This morning
10 o'clock."
"Now is 8.30,
it's a Monday morning, do you believe I can come on time? I don't
even know his case."
"It's a very
complicated case, can't tell you on the phone, come, at once."
I quickly change my
clothes and calling for taxi, rushing to High Court.
I reach the ground
floor of High Court at 9.50 a.m. W. Dragon is trying to delay the
judge from coming to court room, and I am arrived the 15th floor at
10.10 a.m.
I don't even know
the plot of this drama; not even know who is my litigant.
I sat down and start
reading the document. It is a claim from a deceased's brothers
against the deceased's only daughter, to take all of the deceased's
legacy from her.
The deceased was a
South African citizen, and so as all the parties including the
deceased's brothers, and daughter are South African citizens.
The questioned
legacy is a property, an apartment in Hong Kong.
The claimants want
the apartment, because of according to the customary law of South
Africa that no legacy shall be given to daughter.
Now is my turn to present my case, I
stand up and start my defend arguments, "Your Excellency,
according to Basic Law of Hong Kong, article 8, all the previous laws
including customary laws shall be continued enforced in Hong Kong.
However, only the customary laws of Qing Dynasty not the customary
laws of South Africa shall be enforced. Though the parties are South
African citizens, the property of this case was built in Hong Kong.
And this court is in Hong Kong, therefore only the laws of Hong Kong
are admissible in this court. If the claimants cannot present a Hong
Kong case law or any Hong Kong law, which regulates only males of a
family can inherit family's legacy; they cannot claim my litigant's
property.
And the present Hong Kong Customary Law, that the New
Territories aboriginal legacy law was changed, which allows all the
children can inherit their ancestors legacy.”
We won this case.
Dick quickly go to
the office room to talk about the apportionment of litigation costs.
I said quietly to
Dick , "Never pay a single cent."
Then after
everything was done, we are happily leaving High Court. Dick and I
walking in normal pace, deciding on which restaurant we shall go, and W.
Dragon shall pay for the feast. When we turn around, W. dragon and my
litigant were disappeared.
Dick says, " W.
Dragon told me this morning that she is his girlfriend, therefore he
shall not pay you and I in this case. But at least he should pay for
our late lunch."
